Man: Jaywalking leads to police harassment

Dallas man said he was punched, kicked, maced, arrested and spent 11 days in jail for jaywalking. He also said the violent run-in with the officers wasn't his last.

The first incident took place in October, and then a few months later Todd Lyon said it happened again.

Lyon said he and his 14-year-old son got off the train at the West End and crossed the tracks along with several other people.

"We went with the flow...," he said. "So, if we jaywalked so did everyone else. Out of all the people that crossed they seemed to single us out."

Even though they made it across safely, a DART officer ordered them to come back across, which put them in possible danger, Lyon said. According to DART's own report, a southbound train was in motion at the time.

When Lyon and his son declined, they said two officers attacked them. Lyon said he believes it was his long hair that made him a target.

"They grabbed my hand...then my hair and then made derogotory remarks about my hair," he said.

A witness said what he saw next stunned him.

"I saw another officer come in from the right hand side and throw a closed fisted punch at him," Steven Betzen said.

According to a police report, officers ordered Lyon to place his hands behind his back, but when he refused they sprayed him with mace. Lyon said he was thrown to the ground "knees and elbows first."

"I am kicked on the side [and] kneed in the back," he said. "I am maced, handcuffed and laying face down on the pavement."

Officers then kicked Lyon's son, Betzen said.

"At no time did they resist arrest," he said. "In fact, there was no threat at all to the police officers."

Lyon spent 11 days in jail and was ordered by DART police to stay out of the West End station, which didn't mean he was banned from the West End.

On St. Patrick's Day, Lyon said he returned to the West End to celebrate but was taunted by officers. Lyon said they chased him and once again roughed him up.

"I am doing every thing I can to comply and they mace me in the face, and here we go again," he said.

DART police said he was trespassing. They also released what they said was a complete report on the incidents. However, in the first report it didn't even mention Lyon's son. They also left out the fact that DART police left the teenager alone at the West End after taking his father to jail.

DART police also sent a statement saying DART's internal affairs unit believes the officers followed all policies and procedures.

Its almost sounds like he is doing it just to get in trouble. I would think that he'd learn his lesson.

I read the first story a while back. Wish they had it on tape. So far its just what each party says.

Schutze has a follow-up in this week's Observer. According to him, the FBI is now involved. I won't reprint the whole article here (http://www.dallasobserver.com/issues/2006-04-20/news/schutze.html) -- the D.O. needs your ad revenues, right? But he includes a stinging indictment of DART, and the DART board in particular, that brings back memories of the Bad Old Days, when DART was known more for its shiny new fully-appointed West End office than for its shiny new trains.

The DART board is made up of political appointees from Dallas and the suburbs, and the only people they ever have to deal with are the butt-kissers who sit out there hoping to chisel a few million bucks out of them in contracts, jobs and favors.

Try calling a DART board member some day. Try finding a phone number for a DART board member. This is a fat, sassy agency, rolling in big, greasy gobs of tax money, and nobody has to run for office.

I think those cops out there are a perfect reflection of the inner culture of the agency. None of this happens by accident.
Ouch.

Schutze concludes with a plea for the truth:

If you saw any of this, here are two phone numbers, one of which you must call. Lyon's lawyer, Lucas, is at 214-428-5342. Or if your version supports the cops and you don't want to talk to Lyon's lawyer, call the DART police at 214-749-5900.

I have a bias, too -- I really want DART to succeed. But there have been changes at the top since DART's big LRT success, and it would be far too easy for rot-from-the-top to set in again. As Schutze notes, board meetings are open to the public, and the minutes are available online (http://www.dart.org/boardminutes.asp) -- maybe folks like me need to start showing up. DART needs to hear from its friends, because somewhere in the wings, Wendell Cox is waiting for his opportunity...

It was for his own good. Government agents know best and they only exist to protect us from ourselves. This guy should be thankful for them.

Seriously. Just look at how well it worked for governments in the 20th Century.

Not so good if you're one of the less equal animals on the farm though.

You only get to run $300M deficits each year and beat the crap out of harmless people just for kicks if you are DART (or someone else with control of state power). Everyone else actually pays serious consequences for such pathetic behavior.

I disagree with what the majority of you guys are saying. i think mdunlap''s comment is the closest one to which i agree with. i think beating a man is uncalled for for jaywalking. that's excessive and unreasonable force and i hope those police officers loose their jobs for it. If that's what really happened.

i dont blame him for jaywalking. Im not from dallas but i was up here recently and rode DART and got off at west end, and the freakin orange hand stayed up for like 2 minutes while 2 trains were unloading in the station not going anywhere. If they want to prevent jaywalking they need to fix their stupid signals... of course lots of cities are like this...

I know Houston METRO understands this concept...okay bad example ;)

I was seriously thinking about crossing, but there was a DART cop standing at the opposite street corner so i didnt do it...now im glad i didnt...dont wanna get beat up.
